PRECONTRACTUAL INFORMATION - GENERAL TERMS AND CONDITIONS OF SALE

The following general terms and conditions of sale and use (hereinafter referred to as "General Conditions") govern access to the website www.mikaanika.com (hereinafter referred to as the "Site") and its use, and apply to all sales (hereinafter referred to as "Services") provided by Natali @ srl, with registered office at Viale della Mercanzia 92/94 Blocco 2A Galleria A 40050 CENTERGROSS - ARGELATO (BO), VAT number 03702621206.

The use of the Services is allowed only to a registered user who has created an account on the Site and:

is an individual consumer, where consumer means a natural person who acts for purposes unrelated to any business, commercial, craft, or professional activity carried out;
has reached the age of majority;
has read the privacy policy concerning the processing of personal data;
has accepted these General Conditions.

Subject and Scope

These General Conditions apply to the Services provided by Natali@ on the Site. Any new services will be subject to these General Conditions, unless otherwise specified by Natali@.
The offer and sale on the Site constitute a distance contract governed by articles 50 and following of Legislative Decree no. 206 of September 6, 2005 ("Consumer Code") and Legislative Decree no. 70 of April 9, 2003, which regulates electronic commerce.
Natali@ reserves the right to update or modify these General Conditions at any time, provided that the General Conditions published at the time of sending the purchase order apply to each purchase contract. To this end, the user is invited to save a copy of the General Conditions from time to time.
If the user does not intend to accept the changes to the General Conditions, they may terminate the contract by giving notice via email with a 7-day notice. The continued use of the Services beyond this period, as well as the electronic transmission of the order form by the user, constitutes implicit acceptance of the General Conditions.

Registration Process

To use the Services, it is necessary to register on the Site by creating an account and accepting the General Conditions by clicking on the appropriate icon. Failure to accept the General Conditions will prevent registration as a user and making purchases.
Registration on the Site is free of charge. The user declares that the data provided at the time of registration on the Site is correct, complete, and truthful. At the time of registration, the user must also choose a password. Registration will be confirmed via email to the address provided by the user at the time of registration. The user guarantees that the access password to the Site will be used exclusively by the user and not shared with third parties. If the user becomes aware of any unauthorized use of the password by third parties, they must immediately notify Natali@ by sending an email to the following address: amministrazione@imperonatalia.com. In any case, the user can change the password at any time by clicking on the "Recover password" link. An email will be sent to set a new password.
Please note that the data entered during the ordering and registration process will be processed in accordance with the current privacy regulations. Please refer to the privacy policy.
Natali@ reserves the right to refuse, at its sole discretion, registration on the Site as well as the right not to accept orders from anyone if anomalies are found in relation to the quantity of products purchased or if there is a pending dispute with the individuals concerned.

Precontractual Information

In accordance with Legislative Decree no. 70 of April 9, 2003, which contains provisions on electronic commerce, Natali@ informs the user that:

to conclude the contract of purchase of one or more products on the Site, the user must fill in an electronic order form by entering all their details (the user declares that the data provided at the time of the order are correct, complete, and truthful) and following all the different steps of the purchase;
the user can verify and correct any input errors before submitting the order;
the contract is concluded when Natali@ registers the order form, after verifying the correctness of the order and payment details;
once the order form is registered, the user will receive a confirmation email from Natali@ containing a summary of the General Conditions, information about the characteristics of the purchased product, a detailed indication of the price, the payment method used, and the exercise of the right of withdrawal. It is recommended to keep this email as proof of purchase or to store it on a durable medium;
the order form will be stored by Natali@ in its database for the time necessary to process the order, within the limits of the law, and during this period, it may be accessed by the user.

Terms and Conditions of Purchase

The selling price, indicated in the product description for each product, is expressed in Euro/€ and includes VAT. This amount must be added to the order fulfillment and shipping costs, including VAT. The price of the product that will be charged to the user is the one indicated on the Site at the time of submitting the order, in addition to the order fulfillment and shipping costs. The price indicated at the time of purchase is not subject to changes.
Unless expressly stated otherwise, no payment fees or other costs are due.
The products become the property of the user upon payment of the price by the user.
Natali@ reserves the right not to confirm orders from customers with ongoing disputes. Natali@ will process the purchase order only after receiving confirmation of authorization for payment of the total amount due, consisting of the purchase price and any additional costs, as indicated in the order form.

Payment Methods

Payment can be made online by credit/debit card or through a PayPal account.
The credit card will be charged only after verifying the credit card details used for payment and obtaining authorization to charge from the card issuer.

Delivery Methods and Times

Deliveries will be made to the address indicated by the user in the order form. The delivery times are those indicated in the order form and confirmed in the order confirmation. Once the shipment has started, the user will receive a shipping confirmation email.
The transport is entrusted to DHL or GLS. In any case, Natali@ is not responsible for any delays caused by the courier. Transport is NOT covered by comprehensive insurance against theft and/or loss.
IMPORTANT: To ensure prompt and secure delivery, it is necessary for the user to provide the destination address as accurately as possible, including all relevant information, such as floor, apartment number, intercom, etc. It is also important to provide a telephone contact number where the courier can reach the user before the delivery. Natali@ Srl is not responsible for any delays or failed deliveries caused by incomplete or inadequately provided addresses at the time of ordering. Any delays do not entitle the buyer to any compensation for damages of any kind.
In case of non-delivery due to the absence of the recipient, the courier will attempt delivery two more times before returning the goods to the sender.

Service Execution and Refund

Upon conclusion of the contract or payment of the price, Natali@ undertakes to carry out the requested services.
If Natali@ is unable to ship the purchased product, it will promptly notify the user, who will be entitled to a full refund of the payment made within 15 (fifteen) days from the date of sending the notification, excluding any further rights to refunds or compensation for the user.

Right of Withdrawal

Under the Consumer Code, the consumer user has the right to withdraw from the contract without any penalty within 10 (ten) days from the receipt of the products purchased on the Site. In this case, the user will receive a full refund of the price paid for the products, excluding shipping costs.
The withdrawal must be communicated, within the aforementioned period, by sending a specific email to amministrazione@imperonatalia.com.
To return the products to Natali@ Srl, the user must deliver them to an authorized courier for shipment within ten (10) days from the receipt of the products, in the same condition as received, at their own expense. The user is required to keep the products while they are in their possession; otherwise, Natali@ Srl will have the right to contest the refund request.

The following are the steps that the user must take to exercise their right of withdrawal:

within 5 (five) days of receiving the products, the user must send a specific email to Natali@ at the address info@mikaanika.com , stating the intention to return the products;
The products must not have been used, worn, or damaged and must be returned in their original packaging and adequately packaged for safe shipment;
the returned products must be delivered to the authorized shipper within ten (10) days from the date the user informed Natali@ that the product is damaged or defective due to Natali@ itself.

Once the order is canceled within the specified time and in the manner described above, and only after the product is returned or after verifying that the user has returned the goods, Natali@ Srl will proceed with the refund as soon as possible and in any case within 10 (ten) working days. Natali@ Srl will refund the user the full price excluding shipping costs. The amount will be credited to the same means of payment used for the purchase, unless otherwise agreed with the user.

Products can be returned at the user's expense using a courier of their choice.

Warranty and Return Procedure in Case of Non-conforming Product

In case of a defective or damaged product, the user must report any problems or defects to Natali@ within ten (10) days of discovery by sending an email to info@mikaanika.com, indicating the reason and attaching relevant photographs.
Within 5 (five) working days, Natali@ will authorize the return of the product, and within the following 30 (thirty) working days from receiving the product, Natali@ will provide a response regarding the product's defect or issue. If the warranty is accepted, the user has the right to have it repaired or replaced at no additional cost, provided that Natali@ still has the product available or the repair is not excessively costly compared to the value of the product. Otherwise, the user has the right to terminate the contract and, therefore, to be refunded the price or to have the price reduced if they decide to keep the product. Please note that it is necessary to return the products in the same condition as received, at your own expense, using a courier of your choice.

Return Procedure for Non-conforming Products:

the user must send a written request as soon as possible and in any case within 10 (ten) days from receiving the product, by sending an email to info@mikaanika.com, indicating the reason for the return and attaching relevant photographs. It is recommended to keep a copy of this request;
the products must be returned in their original packaging and adequately packaged for safe shipment;
the returned products must be delivered to the authorized shipper within 5 (five) days from the date the user notified Natali@ that the product is damaged or defective due to Natali@ itself.

If Natali@ does not recognize its responsibility for the returned product's damages, it will send a communication stating that the returned product cannot be accepted. In this case, the user may request that the defective or damaged product be returned to them.
If the recipient of the product indicated in the order form is different from the person who made the payment for that product, the amount paid for the return will be refunded by Natali@ Srl to the person who made the payment. The currency of the refund will necessarily be the same as the original debit currency to avoid losing interest. The refund will be made using the same means of payment used for the purchase.
Natali@ will not be liable for any delays beyond its control, including delays caused by the purchase or refund process, including, for example, delays caused by the refund policies of each credit institution.

Website Content and Intellectual Property

The graphic representation of the Site, texts, images, and all compilations of software, source code, the software itself, as well as any material present on the Site, are the exclusive property of Natali@ Srl. All rights reserved. The user has the right to make a paper or electronic copy of parts of the Site for the sole purpose of purchasing a product represented therein. Reproduction, modification, duplication, copying, distribution, sale, or any other exploitation of the images and content of the Site without the prior written authorization of Natali@ Srl is prohibited. Any use of the Site's content for commercial and/or advertising purposes is also prohibited.

Applicable Law and Jurisdiction

These General Conditions are governed by the Consumer Code and Legislative Decree no. 70 of April 9, 2003, in the field of electronic commerce. The Contract is governed and interpreted in accordance with Italian law.
For the resolution of any civil disputes arising from the interpretation, execution, and resolution of this Contract, the territorial jurisdiction is non-derogable to the judge of the place of residence or domicile of the consumer if located in Italy. For other users, the competent court is the Court of Rovigo.
For completeness, it is informed that in the event of a dispute, it is possible to file a complaint under Article 14 of Regulation 524/2013 through the EU ODR platform accessible at the following link: http://ec.europa.eu/consumers/odr/. The ODR platform is a point of access for users willing to resolve out-of-court disputes arising from online sales or services contracts.
