PRE-CONTRACTUAL INFORMATION – GENERAL TERMS AND CONDITIONS OF SALE AND USE

These general terms and conditions of sale and use (hereinafter the “General Conditions”) govern access to and use of the website www.mikaanika.com (hereinafter the “Site”) and the purchase of products offered through the Site (hereinafter the “Products” or “Services”).

The Services are provided by Natali@ Srl, with registered office at Circonvallazione delle Merci 7, Block 22 bis, Centergross, Funo di Argelato, 40050 (BO), Italy, Tax Code and VAT No. 03702621206 (hereinafter the “Seller”).

Purchases on the Site are allowed both to registered and non-registered users. Orders may be placed without creating an account by entering the data required for shipping and invoicing during checkout.

Only users who:

  • are consumers, i.e. natural persons acting for purposes unrelated to any business, commercial, craft or professional activity;
  • are at least 18 years old;
  • have read the privacy policy concerning the processing of personal data;
  • accept these General Conditions;
    may use the Services.

1. Subject and Scope

These General Conditions govern the Services offered by the Seller through the Site. Any new features or services made available on the Site shall be governed by these General Conditions, unless otherwise expressly stated by the Seller.

The offer and sale of products on the Site constitute a distance contract governed by Articles 50 et seq. of Legislative Decree 6 September 2005, No. 206 (the “Consumer Code”) and by Legislative Decree 9 April 2003, No. 70 on electronic commerce.

The Seller reserves the right to update or amend these General Conditions at any time. For each order, the General Conditions published on the Site at the time the order is submitted shall apply. Users are invited to read them carefully and, if desired, save a copy.

If the user does not intend to accept the amendments, they may stop using the Site and the related Services. Continued use of the Site after publication of amendments and/or submission of a purchase order constitutes acceptance of the updated General Conditions.

2. Registration

Registration on the Site is optional. Users may purchase Products without creating an account by entering the shipping and billing details during checkout.

However, registration allows a simpler and more complete shopping experience. In particular, by creating an account the user may:

  • save shipping and billing details for faster future purchases;
  • view order history at any time;
  • track shipments and receive updates;
  • manage assistance, return or withdrawal requests more easily;
  • access, where applicable, communications or initiatives reserved to registered users.

If the user wishes to register, they may create a free account by completing the relevant form and accepting these General Conditions. The user declares that the data provided during registration are correct, complete and truthful.

At registration the user chooses a personal password. Registration is confirmed by email to the address provided by the user. Users must keep their credentials confidential and not share them with third parties. If the user becomes aware of any unauthorised use, they must promptly notify the Seller by writing to info@mikaanika.com. Passwords may be recovered or changed at any time through the “Recover password” function by following the instructions sent by email.

Data provided during registration and ordering are processed in compliance with applicable personal data protection laws. Please refer to the Privacy Policy available on the Site.

The Seller reserves the right to refuse or cancel, at its sole discretion, registrations or orders that appear anomalous in terms of quantity, frequency or purchasing method, or placed by users with whom a dispute is pending.

3. Pre-contractual Information

Pursuant to Legislative Decree No. 70 of 9 April 2003 on electronic commerce, the Seller informs the user that:

  • to purchase one or more Products on the Site, the user must complete an electronic order form, entering all requested information and following all checkout steps. The user declares that data provided at order time are correct, complete and truthful;
  • before submitting the order, the user may verify and correct any input errors;
  • the order is deemed received by the Seller when the user completes checkout and submits the order form;
  • after submitting the order, the user receives an automatic order confirmation by email confirming receipt of the order by the Site;
  • for electronic payments, the order amount is verified and accounted for at shipping time; therefore the order is validated and handed to the courier only after payment acceptance by the payment institution;
  • once the order is validated and handed to the courier, the user receives an email containing:
    • order number,
    • order date,
    • list of purchased items with quantity and features (size/colour),
    • price paid for each item and total amount,
    • payment method used,
    • a summary of these General Conditions and instructions for exercising the right of withdrawal.
      Users are advised to keep this email as proof of purchase or store it on a durable medium;
  • the order form is stored in the Seller’s database for the time necessary to fulfil the order and in any case within statutory limits. During this period the user may request a copy or consult it as provided by the Site.

4. Terms and Conditions of Purchase

The selling price of each Product is indicated on the relevant product page on the Site, is expressed in Euro (€) and includes VAT.

Shipping costs are not included in the Product price. The shipping fee is calculated at checkout based on the destination country and ranges generally from €7.00 to €45.00. The final shipping cost is shown clearly before order confirmation.

The price charged to the user is the one published on the Site at the time the order is submitted, plus shipping costs displayed at checkout. The confirmed price does not undergo subsequent changes. Unless otherwise specified, no additional payment costs apply other than those expressly indicated in the order form.

Products remain the Seller’s property until full payment is received. For electronic payments, the order is validated and handed to the courier only after payment acceptance by the payment institution and is accounted for at shipping time.

The Seller reserves the right not to confirm or to cancel orders from users with pending disputes or orders deemed anomalous in quantity, frequency or purchasing method.

5. Payment Methods

Payment may be made online by:

  • debit, credit or prepaid card (any circuit);
  • PayPal, including via app;
  • Klarna instalment payments, where available at checkout.

Users completing orders from mobile devices may also speed up payment by selecting Apple Pay or Google Pay, if available on the device and among checkout options. These methods operate through the electronic payment circuits supported by the device.

For electronic payments, the user receives an automatic confirmation email at the end of checkout. The amount is verified and accounted for at shipping time; therefore the order is validated and handed to the courier only after payment acceptance by the payment institution.

For card payments, the charge is made only after verifying card details and receiving authorisation from the issuer/processor.

6. Delivery Methods and Times

Deliveries are made to the address indicated by the user in the order form. Estimated delivery times, where available, are shown during checkout and confirmed in the order confirmation email. Once the shipment is handed over to the courier, the user receives a shipping confirmation email with tracking details.

Worldwide shipping

The Seller ships worldwide, using international couriers selected on the basis of destination and service availability.

Shipping costs

Shipping costs depend on the delivery country and the selected service. Fees generally range from €7.00 to €45.00. The exact shipping cost applicable to the order is calculated automatically and displayed at checkout before the user confirms the purchase.

Temporary suspension of shipments

At present, shipments are temporarily suspended to the following countries/areas:

  • United States (USA)
  • United Kingdom (UK)
  • Ukraine (UA)
  • Russia (RU)
  • Israel (IL)

Orders with delivery addresses in these countries cannot be processed until the suspension is lifted. The Seller will update the list of suspended destinations directly on the Site when changes occur.

Responsibility and delivery issues

The Seller is not responsible for delays attributable to the courier, customs procedures, local restrictions, force majeure, or other causes beyond the Seller’s reasonable control.

To ensure safe and timely delivery, the user must provide a complete and accurate address (including street, number, apartment, floor, intercom code where applicable) and a valid phone number. The Seller shall not be liable for delays, failed deliveries, or additional costs arising from incomplete or incorrect delivery details.

In case of failed delivery due to the recipient’s absence, the courier will follow its standard policy for additional attempts and/or storage. Any consequences, storage time, or related costs are governed by the courier’s rules and are not attributable to the Seller.

7. Service Execution and Refund

Upon conclusion of the purchase contract and receipt of the order, the Seller undertakes to fulfil the requested Services by preparing and shipping the Products as described in these General Conditions.

If, for any reason, the Seller is unable to fulfil and ship the purchased Product, it will promptly inform the user. In such case, the user is entitled to a full refund of any amount paid, within 15 (fifteen) days from the notification date, using the same payment method used for purchase.

Any further rights to refunds or compensation are excluded.

8. Right of Withdrawal

Pursuant to the Consumer Code, the consumer user has the right to withdraw from the contract without penalty within 14 (fourteen) calendar days from the day of receipt of the Products.

How to exercise withdrawal

To exercise the right of withdrawal, the user must:

  1. Notify withdrawal within 14 days from receipt of the Products by sending an email to info@mikaanika.com, indicating:
    • order number;
    • the items to be returned.
  2. Ship the Products within 14 days from receipt of the order, using a courier of the user’s choice and at the user’s expense.

Conditions of returned Products

Returned Products must be:

  • intact and in perfect condition;
  • not used, not worn and not washed;
  • complete with original packaging and accessories;
  • properly packed for safe shipment.

The user must take reasonable care of the Products until return; otherwise the Seller may contest the refund request.

Refund

Once the returned Products are received (or shipment within the deadline is proven), the Seller will refund as soon as possible and in any case within 10 (ten) working days.

The refund covers the price of the returned Products only. Shipping costs are not refundable unless otherwise required by mandatory law. The amount will be credited to the same payment method used for purchase.

9. Warranty and Return Procedure for Non-conforming Products

Defective or non-conforming Product

If a Product is defective, damaged or non-conforming, the user must report it as soon as possible and in any case within 10 (ten) days from receipt/delivery by sending an email to info@mikaanika.com including:

  • order number;
  • description of the defect;
  • clear photographs of the Product and, if relevant, the packaging.

The Seller will reply within 5 (five) working days authorising (or not) the return. After receiving the returned Product, the Seller will assess the claim within 30 (thirty) working days.

Outcome of warranty

If the defect is acknowledged:

  • the user is entitled, at the Seller’s choice, to repair or replacement at no extra cost, provided the Product is available and repair is not excessively burdensome compared to the Product’s value;
  • if repair or replacement is not possible, the user is entitled to terminate the contract with refund or to obtain a price reduction if they prefer to keep the Product.

If the defect is not acknowledged as attributable to the Seller, the Seller will notify the user in writing. In that case, the user may request re-shipment of the Product at their own expense.

Return of non-conforming Products

To return a non-conforming Product, the user must:

  1. send the request by email within 10 days from delivery with the required photos;
  2. wait for the Seller’s authorisation before shipping;
  3. return the Product in original packaging, complete with accessories and properly packed;
  4. ship the return within 5 (five) days from authorisation, using a courier of their choice and at their expense, unless otherwise indicated by the Seller.

Refunds

When due, refunds are made using the same payment method used for purchase.
If the recipient indicated in the order form differs from the payer, any refund will be issued to the payer in the same currency as the original charge.

The Seller is not responsible for delays due to causes beyond its control, including technical processing times applied by payment institutions.

10. Privacy and Data Processing

11. Website Content and Intellectual Property

The Site layout, texts, images, trademarks, logos, design, source code, software and any other material or content on the Site are the exclusive property of Natali@ Srl or of the respective rights holders. All rights reserved.

Users may make paper or electronic copies of parts of the Site solely for personal use and for purposes related to purchasing the Products offered.

Any reproduction, modification, duplication, copying, distribution, publication, sale or exploitation, in whole or in part, of the Site contents without the Seller’s prior written authorisation is prohibited. Any commercial and/or advertising use not expressly authorised is also prohibited.

12. Applicable Law and Jurisdiction

hese General Conditions are governed by the Consumer Code and Legislative Decree No. 70/2003 on electronic commerce. The purchase contract is governed and interpreted in accordance with Italian law.

For any civil dispute arising from the interpretation, execution or termination of this contract:

  • for consumer users, mandatory territorial jurisdiction lies with the court of the consumer’s place of residence or domicile, if located in Italy;
  • for all other users, the competent court is the Court of Rovigo.

Users are also informed that, in case of dispute, they may use the EU ODR (Online Dispute Resolution) platform for out-of-court resolutions of disputes arising from online sales or service contracts.
